GUIDANCE – INFORMATION: Defining and Managing Emergency Relief Repair Activities Eligible for 100% Federal Funding (Revised)

This memo clarifies how the FHWA exercises flexibility in response and program management for emergency situations, considering factors such as the nature of the event, extent of damage, and agency capabilities. It guides the interpretation and application of relevant federal laws and replaces a prior FHWA memo titled 'GUIDANCE – INFORMATION: Defining and Managing Emergency Relief Repair Activities Eligible for 100% Federal Funding,' dated April 14, 2021.

FHWA Order 5182.1

FHWA memo provides procedures for administration of the ER Program, including requirements to ensure all initial DAFs are submitted to FHWA for approval within 3 months of the Disaster Declaration Date and that when project costs exceed 120% of the of the approved DAF estimate, the DAF must be revised.

Event Eligibility and Funding Needs: ER DSSR and PoP

FHWA memo defines the approved DAFs, included in the Program of Projects, as the basis for immediate and future ER funding needs and clarifies the applicability of Directors Orders and Initial Damage Estimates provided in the Damage Survey Summary Report.

Federal Authorization of ER Projects

FHWA memos clarified the ER Program requirement to identify permanent repair work performed under an Emergency Opening (EO) project. FHWA requires Districts to provide a PR Certification Letter justifying the need to include PR with the EO project.  Also, if applicable, a Betterment Cost justification is also required.

FHWA  Construction Start Deadline - ER PR Time Extension Request

FHWA has issued guidance for ER Time Extensions required for ER-funded Permanent Restoration projects which have not reached Construction authorization by the end of the 2nd fiscal year of the year in which the disaster occurred.
