Section 106 PA/PRC 5024 MOU Renewal

Thank you to all who provided comments on the draft Second Amended Section 106 Programmatic Agreement Among the Federal Highway Administration (FHWA), the Advisory Council on Historic Preservation (ACHP), the California State Historic Preservation Officer (SHPO), and the California Department of Transportation Regarding Compliance with Section 106 of the National Historic Preservation Act, As it pertains to the Administration of the Federal Aid Highway Program in California (106 PA) and the draft First Amended Memorandum of Understanding Between the California Department of Transportation and the California State Historic Preservation Officer Regarding Compliance with Public Resources Code 5024 and Governor's Executive Order W-26-92 (5024 MOU).

The second and final comment period ended on September 1, 2023. Caltrans has taken comments from tribes, local and federal agencies, preservation groups and other interested parties into account and developed third revised drafts of the 106 PA and 5024 MOU for final signatory review. Caltrans has also produced an updated comment matrix documenting revisions and responses to comments received. Links to these documents can be found below.
