NOTICE OF PROPOSED EMERGENCY RULEMAKING
The Department of Transportation (Caltrans) is proposing to adopt emergency regulations to implement Senate Bill 959 (Portantino, 2022) concerning the State Route 710 (SR 710) Sales Program specific to surplus properties located in the City of Pasadena in Los Angeles County. Government Code Section 11346.1(a)(2) requires that, at least five working days prior to submission of a proposed emergency action to the Office of Administrative Law, the adopting agency must provide a notice of the proposed emergency action to every person who has filed a request for notice of regulatory action with the agency. After submission of the proposed emergency to the Office of Administrative Law, the Office of Administrative Law shall allow interested persons five (5) calendar days to submit comments on the proposed emergency regulations as set forth in Government Code section 11349.6. This document provides the required notice.
Upon filing the proposed emergency regulations, the Office of Administrative Law will have ten (10) calendar days to review and decide on the proposed emergency regulations. If the emergency regulations are approved, the Office of Administrative Law will file the regulations with the Secretary of State and the emergency regulations will remain in effect until September 30, 2024, pursuant to Government Code, § 54239.5(e)(3).
Caltrans will proceed to make the emergency regulations permanent through a regular rulemaking action, including a public comment period, prior to September 30, 2024. The emergency regulations will remain in effect during this rulemaking action.
SUBMISSION OF COMMENTS
Any interested person may submit written comments relevant to the proposed emergency regulatory action via U.S. mail or e-mail. The Office of Administrative Law must receive written comments within five (5) calendar days after Caltrans submits the emergency regulations to the Office of Administrative Law. A copy of the comments must also be submitted to the rulemaking agency (Caltrans). Submittals should reference that the comments are being submitted to the Office of Administrative Law for consideration in connection with an emergency regulation concerning the “SR 710 Sales Program” addressed as follows:
