The responses to bidder inquiries, unless incorporated into formal addenda to the contract, are not a part of the contract, and are provided for the bidder’s convenience only. In some instances, the question and answer may represent a summary of the matters discussed rather than a word-for-word recitation. The availability or use of information provided in the responses to bidder inquiries is not to be construed in any way as a waiver of the provisions of 2-1.07, “Job Site and Document Examination,” of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications, or special provisions nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response given previously.

Inquiry 1)  Are there any fees for City of Mountain House or San Joaquin County the contractor needs to take care of? In speaking with Mr. Steven Hollenbeak at City of Lathrop as noted in spec page 8, he mentioned the contractor maybe encroaching the agencies forementioned. Please advise who will bear these fees.

The response below supersedes the previous response to Bid Inquiry #1.

Response 1)  According to the Notice to Bidders and Special Provisions for Contract No. 10A2883, Specification Section 5-1.20B(3) on page 8, the City of Tracy (Location Nos. 1 through 7) and City of Lathrop (Location Nos. 8 and 9) were the local agencies listed for encroachment permit requests. Also, location No. 1 and No.2 are on the border of City of Tracy and City of Mountain house. Furthermore, this specification states in paragraph 8 that, “You are responsible for all fees related to processing and obtaining encroachment permits from these local agencies.” So therefore, the Department does not pay for encroachment permits or fees associated with encroachment permits.

Inquiry 2)  Confirmation of department furnished items required since project documents differ. See below.

  • Project spec page 9 state the Department will furnishes with: Controller assemblies, including Model 332LS controller cabinet for traffic signals The Department furnishes you with completely wired controller cabinets with auxiliary equipment but without controller unit at Caltrans Electrical Maintenance, 1604 South B Street, Stockton, CA 95206. At least 48 hours before you pick up the materials, inform the Engineer of what you will pick up and when you will pick it up.
  • Page 27 of the project specs indicates:
    Signal heads
    Department-furnished controller cabinet
    Battery backup system
  • Project plan sheet E-11 as one example states:
    INSTALL DEPARTMENT FUNISHED MODEL 332 LS CONTROLLER CABINET...

Response 2)  As per section 87-21.03C, section 6-1.02 and project plan sheet E-11, this is to confirm that Controller assemblies, including Model 332LS controller cabinet for traffic signals will be Department furnished (without controller unit) and can be picked up at Caltrans Electrical Maintenance, 1604 South B Street, Stockton, CA 95206.
