Response #2:The construction detail shown on C-10 is to construct what is commonly referred to as the "bend and pin" method of installing desert tortoise exclusion fence. Instead of burying the fence 18" into the ground, the fencing is bent into an "L" shape; part of the fence is vertical (as shown in the front view) and part is horizontal (as shown in the plan view). The 18' shown on the plan view is a typo, it is supposed to read 18" minimum (no need for the word "variable" either).

The bent rebars are there to pin the horizontal portion of the fence to the ground, similar to a tent stake.

Inquiry #2: 12-10.10 Wardrobe Lockers and Benches, Part 2 calls for locker bodies to be minimum 24 gauge steel and electrically spot welded. Locker bodies of 24 gauge steel are too thin to be spot welded and may only assembled using nuts and bolts or rivets.

Please advise if assembly using nuts and bolts or rivets is permissible, or if locker bodies must be assembled by spot welding, which will require the locker bodies to be upgraded to heavier 16 gauge material. Upgrading locker bodies to 16 gauge will increase the locker cost by approximately one hundred thirty per cent of the cost of lockers with 24 gauge bodies.

Response #2:1-The site access road is directly from the Freeway I-15 or the Nipton road off ramp lead to the dirt road which is belong to BLM land.

2-Since the JPOE footprint has been fenced off by Brightsource, we may not need biologists for all construction phases.

3-The Oct. 1, 2010 B.O. can be provided, but it is for the Brightsource Energy’s Ivanpah Solar Electric Generating Project, which is outside of the JPOE project. The Brightsource Project had desert tortoise fencing requirements for the JPOE project footprint, which have since been fulfilled. Please inform if you would like a copy of this B.O. The B.O. for JPOE is dated March 31, 2006.

Response #3:There are two major documents. A Biological Opinion and a 2081`. The 2081 says tortoise monitor(s) must be on-site for “Covered Activities” …that means any for action that might threaten tortoises, there has to be tortoise monitors. The 133 acres is already tortoise-fenced off, but it is not cleared and grubbed. The contractor will have to hire biologist(s) who are approved by the US Fish & Wildlife and California Fish & Wildlife. Those approved biologists will have to be on-site during any clearing and grubbing.(Or any ground disturbance for that matter).

If any new tortoise fence has to be installed, say from the existing permanent tortoise fence along Ivanpah Channel on P. L-8 of the plans, then a tortoise monitor has to be there for that. In other words, any ground disturbance needs a monitor. Ivanpah Solar had a few tiny tortoises pop up after some of their land was cleared and grubbed and fenced-off!

Once clearing and grubbing is done, the contractor-hired biologist will not have to be on-site for all construction activities.
