ENCROACHMENT PERMITS

IMPORTANT NOTICE:

Effective July 1, 2009 as directed by Governor Schwarzenegger's Executive Order S-13-09, District Encroachment Permit Offices will be closed as follows:

For the month of July 2009 the dates will be Fridays, July 10, 17, and 24.

Beginning in August 2009 and for all subsequent months, office closures will be in effect on the first three Fridays of the month.

 

What we do:

The use of California State highways for other than normal transportation purposes may require written authorization from the Department of Transportation. As the responsible Department for protecting the public's investment in the State highway system, Caltrans reviews all requests from utility companies, developers, volunteers, nonprofit organizations, etc., desiring to conduct various activities within the right of way. Such activities could include for example: construction of highway improvements, driveway installation and maintenance, highway landscaping and graffiti removal, commercial filming, special events such as parades commemorating an event, e.g. Independence Day.

Requests for the right of way ingress are prepared on a Standard Encroachment Permit Application and must be submitted to the district having geographical jurisdiction of the proposed encroachment site [Acrobat PDF]. Applications are also available from each of the 12 Districts.

NOTICE OF MODIFICATIONS TO TEXT OF PROPOSED REGULATIONS AND ADDITION OF DOCUMENTS AND INFORMATION TO RULEMAKING FILE

Pursuant to the requirements of Government Code section 11346.8, 11346.9 and section 44 of Title 1 of the California Code of Regulations, the California Department of Transportation is providing notice of changes made to proposed regulations in Chapter 21 of the California Code of Regulations and that additional documents and other information which the agency has relied upon in adopting the proposed regulations have been added to the rulemaking file. The proposed regulations were the subject of a regulatory hearing on May 22, 2008 and two 15-day written comment periods between September 8, 2008 and September 25, 2008 and between December 3, 2009 and December 19, 2008. The changes to the proposed regulations and additional documents that have been added to the regulatory rulemaking file are in response to recommendations to a Decision of Disapproval of Regulatory Action issued on May 11, 2009 by the Office of Administrative Law.

If you have any comments regarding the proposed changes, the Department will accept written comments between June 8, 2009 and June 23, 2009. All written comments must be submitted to the Department no later than 5:00 p.m. on June 23, 2009, and addressed to:

All written comments received by June 23, 2009, which pertain to the indicated changes will be reviewed. The Department’s staff will respond to the comments as part of the compilation of the rulemaking file. Please limit your comments to the modifications to the text.

WIRING CALIFORNIA: BROADBAND IN CALTRANS RIGHTS-OF-WAY

Executive Order S-23-06 Acrobat PDF found that “…State action is needed to continue investment in, stimulate adoption of, and remove further barriers to the development of world-class broadband networks...” The Executive Order directed the Business, Transportation, and Housing (BTH) Agency to lead a statewide effort to streamline permitting within State rights of way (ROW) and state agencies to coordinate their implementation efforts. 

Consistent with the Executive Order S-23-06 and recommendations from the Broadband Task Force Report, this forum brings together the Department of Transportation (Caltrans) and the California Public Utilities Commission (CPUC), local communities, and broadband providers to discuss how to promote further deployment of broadband within ROW. 

The forum addressed the folowing:

  1. Current procedures for deploying fiber and conduit along state highways
  2. Roles of Caltrans and the CPUC in permitting or facilitating deployment of conduit and fiber along state highways
  3. Whether improvements to current processes and procedures are necessary and, if so, proposals for such improvements.
