Determine Method of Right of Way Cleanup

Narrative

The right of way process includes more than acquisition of property. The right of way must be cleared of obstructions that were not previously removed. Projects may have workaround clauses, but policy requires the right of way to be cleared and cleaned before the highway contractor is allowed to begin construction on that property.

Sub-Tasks

• Inspect the right of way and identify items that must be removed. Notify the Project Engineer of items that are to be included in the clearing and grubbing contract item.
• Arrange for right of way cleanup by requiring a demolition contractor to perform additional cleanup; otherwise, prepare a separate minor contract.

• 15 - 60 days

TASK D427 (410.B)

Complete Right of Way Certification

Narrative

Previous right of way activities performed the calculations, appraisals, negotiations, and acquisitions required for Right of Way Certification. Certification requirements must now be completed so that the project can be advertised.

• District Office Engineer

Sub-Tasks

• Contact the Right of Way Branch to determine if the Right of Way Certification is still valid.
• If Right of Way Certification is a No. 3 or No. 3 with "Workarounds", request the Right of Way Branch to indicate when a No. 2 or No. 1 will be available. A No. 1 or No. 2 Certification must be obtained prior to bid opening.
• Include the Right of Way Certification Letter in the draft contract documents.
