The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.

Q) "Surplus excavated material not designated or determined to contain aerially deposited lead shall become property of the conrtractor" What happens to the surplus excavated material determined to contain aerially deposited lead? How is it paid for?

A) Please refer to Section 5-1.14, "Aerially Deposited Lead" of the Special Provisions. The soil to be excavated was tested and found to contain non-hazardous levels of lead. (Refer also to Section 6.1, "Waste Classification" of the "Aerial Lead Site Investigation Report" included in the Information Handout.) Therefore, the "Roadway Excavation" item has not been designated as "Aerially Deposited Lead." All excavated material shall become the property of the Contractor and shall be disposed of in accordance with Section 10-1.17, "Earthwork," of the Special Provisions. Roadway Excavation will be paid for in accordance with Section 19-2.09, "Payment" of the Standard Specifications.


Q) Is it true that there are no cross-sections available for this project. If not, how was the roadway excavation quantity calculated?

A) No, cross sections were not made available. Due to the flat terrain and alignment of the work, the roadway excavation quantity was estimated based on the projection of one cross section for the length of the project.
